Terms of Service

Welcome to the Connected Vehicle Service powered by Noetiq technology (hereinafter referred to as the "Service"). This Service is developed and operated by Noetiq (hereinafter referred to as "we" or "us") as commissioned by the Vehicle Manufacturer (hereinafter referred to as the "OEM").
Please read the following terms carefully before using the Service.
1. Service Relationship
- B2B2C Model: This Service constitutes part of the add-on or subscription services for the vehicle you purchased. While Noetiq is responsible for providing the underlying technical platform, App interface, and data processing capabilities, your legal service agreement is primarily established with the OEM.
- License to Use: You are granted a non-exclusive, non-transferable right to use the App and related software. All intellectual property rights remain with Noetiq or the OEM.
2. Account and Login
- SSO Login: The Service may support Single Sign-On (SSO) via Google or Line accounts. You are solely responsible for ensuring the security of these third-party accounts.
- Account Responsibility: You are responsible for safeguarding your login credentials. You bear full responsibility for any liability resulting from unauthorized use of your account due to your failure to secure your credentials.
3. Data Use Authorization
You understand and agree that to provide the Service, the App will automatically collect vehicle data (e.g., location, vehicle status, driving data) and transmit it to the cloud platform.
- Scope of Authorization: You agree that Noetiq may collect, process, store, and analyze the aforementioned data in accordance with the Privacy Policy and the OEM's instructions.
- Data Ownership: Intellectual property rights and usage rights regarding de-identified statistical data or analysis models derived from such data belong to Noetiq or the OEM. This data may be used to improve algorithms and enhance service quality.
4. Limitations and Disclaimers
- Non-Continuous Monitoring: The Service relies on mobile communication networks and GPS signals. It may be interrupted due to signal blind spots, device malfunctions, or anomalies in cloud services (GCP/AWS/Azure). We do not guarantee uninterrupted or zero-latency service.
- For Reference Only: Vehicle status information and diagnostic results displayed in the App are for reference purposes only and do not possess legal validity, nor do they replace professional physical inspection and maintenance. If the App indicates normal status but the vehicle exhibits actual physical abnormalities, the actual condition of the vehicle shall prevail.
- Limitation of Liability: To the extent permitted by law, Noetiq shall not be liable for any indirect or incidental damages arising from the use of or inability to use the Service. In the event of any service dispute, you should prioritize contacting the OEM for resolution.
5. Service Changes and Termination
- We reserve the right to update App features or revise these Terms at any time.
- If your service contract with the OEM terminates (e.g., due to vehicle resale or subscription expiration), your right to use this Service will terminate accordingly.
6. Governing Law and Jurisdiction
The validity, interpretation, and application of these Terms shall be governed strictly by the governing law and jurisdiction clauses set forth in the Master Service Agreement signed between you and the OEM (Service Provider). Any disputes arising from this Service shall be resolved in accordance with the dispute resolution mechanism stipulated in said Master Service Agreement.
